Erosion Control Requirements for Texas Construction Sites

If you're disturbing ground in Texas, at some acreage the stormwater rules apply to you. Here's the practical version — what triggers coverage, what inspectors look for, and where Gulf Coast sites differ from the rest of the state.

What triggers coverage

Construction stormwater in Texas runs through TCEQ's Construction General Permit, TXR150000. The threshold that matters most:

Erosion control and sediment control are not the same thing

These get used interchangeably on job sites, and it causes real problems because inspectors look for both.

Erosion control stops soil from moving in the first place. Slope stabilization, mulch blankets, vegetative cover. It works at the source — the exposed surface itself.

Sediment control catches soil that's already moving. Silt fence, wattles, sediment basins. It works at the perimeter — the exit point.

A site running only perimeter controls is asking a fabric fence to hold back an entire slope every time it rains. Eventually it doesn't. Establishing cover on the exposed surface takes the load off everything downstream, and it's the only part of the system that gets stronger over time as roots take hold.

Inspection cadence

The permit sets an inspection schedule — commonly every 7 days, or every 14 days paired with an inspection within 24 hours of a rain event of half an inch or more. Records are kept and retained.

The practical implication of the rain trigger: on the Gulf Coast, half an inch is not an unusual event. Plan for inspections to be driven by weather, not by the calendar.

The expensive failure isn't the fine. When a slope washes before it's stabilized, you're not just reinstalling controls — you're re-grading ground you already paid to grade, on a schedule that no longer has room for it. Stabilizing at the right moment is almost always the cheaper path, and the right moment is usually earlier than people plan for.

Why Gulf Coast sites are harder

A spec written for another part of the country tends to be marginal here, for three compounding reasons.

The soil doesn't absorb. Much of Southeast Texas sits on the Beaumont Formation — heavy clay with very slow permeability. Rain doesn't soak in at anything near the rate it falls, so it runs. On a disturbed slope, that runoff is what carries your grade downhill.

The rain arrives all at once. This isn't a region of gentle, distributed rainfall. It's a region of intense events that drop inches in hours, plus a hurricane season that produces conditions no perimeter control handles alone.

Flat ground concentrates flow. On terrain this level, water doesn't disperse — it finds the low line and channels. That's why ditches and swales scour out here while the ground beside them holds.

The practical upshot is that tackifier rates and mulch loading adequate elsewhere are thin here, particularly on fresh cut slopes.

Sequencing

The mistake that costs the most is treating stabilization as a closeout activity. Ground that will sit idle for weeks should get temporary stabilization now, protecting the grade you already have. Final stabilization comes later, when the site is ready for permit closeout.

Practical order on most sites:

  1. Perimeter sediment control before ground disturbance
  2. Inlet protection where storm drains could receive site runoff
  3. Temporary stabilization on any area going dormant
  4. Maintain and document throughout — sediment removed as it loads
  5. Final vegetative stabilization for closeout, then control removal

Silt fence, installed correctly

Since it's the most common control on any site: the overwhelming majority of silt fence failures happen underneath the fence, not through it. The bottom edge of the fabric has to be trenched in and backfilled. Leave a gap and water simply runs beneath a barrier that looks perfectly installed from the road.

Also: silt fence is for sheet flow. It is not a check dam. Install it across a concentrated channel and it will fail, because it was never designed for that load.
